When it comes to the expansion of federal power, the Obama administration stands in a class all its own. President Obama’s EPA has taken over more Clean Air Act regulatory programs away from states than the previous three administrations combined—by a multiple of 10. The agency has given access and influence once reserved for the states—who are supposed to function as the EPA’s co-sovereigns—to environmental special interests. Thus, the Obama administration has undermined the Clean Air Act’s system of cooperative federalism, as designed by Congress
