The DC Circuit Court has ruled to strike an IRS interpretation of the Affordable Care Act (ACA) that granted subsidies to individuals purchasing insurance in the 36 Exchanges established by the Federal government. As a result, Americans will be exposed to the full costs of ACA, which will necessitate a restructuring of the private health insurance landscape. Governors in those 36 states will have to seriously consider expansion in order to shield individuals in those states from the costs of the Federal reform law, or else the law will have to be modified by Congress.
